Terms of service

Who we are
Kinhour is run by LUZAURA, LDA, Rua de Volta da Manhã, Prado Villas, 8125-406 Quarteira, Portugal, NIPC 518676161 ("we"). You can reach us at support@kinhour.com, or use the contact page.
What these terms cover
These terms apply when a studio, gym, club or other business (you) uses Kinhour to run its timetable, bookings, courts, memberships, payments and messages. Your own clients book with you under your terms and policies, not ours. How we handle their personal details is set out in the privacy notice and the data processing terms.
Your account and your team
- The person who creates a workspace accepts these terms for the business.
- Each person who signs in uses their own account, with a role (owner, manager, front desk or teacher) that sets what they can see and do.
- You are responsible for what your team does in your workspace and for keeping sign-in details safe. Tell us straight away if you think your account has been used without permission.
Trial, plans and payment
- Every workspace starts with a 14-day free trial. No card is needed for the trial.
- Paid plans are billed monthly in euros, in advance, by card through our payment provider, Stripe. Prices are in euros and exclude VAT. Businesses in the EU can add a VAT number at checkout.
- Moving to a different plan takes effect straight away, and the difference is worked out on your next invoice.
- You can cancel at any time in Settings. Your plan runs to the end of the month you paid for. Payments already made are not refunded for part of a month, except where the law requires it.
- When a trial or a plan ends, adding new things pauses. Your booking pages stay open for 30 days after the end date, then online booking pauses until you choose a plan. Nothing is deleted, and choosing a plan opens everything again straight away.
Your clients' payments
- Your clients pay you through your own Stripe account, connected to Kinhour. We do not take a share of those payments. Stripe's own terms and fees apply to your Stripe account.
- You are the seller. Your prices, refunds, cancellation fees, gift cards and disputes with your clients are between you and them. You set your cancellation and booking rules in Kinhour and they are shown to clients before they book.
- A client's card is saved for later payments only when the client agrees to it. When a court booking is shared, the organiser is told before paying how unpaid shares are settled.
- Where you must issue certified invoices, you connect your own invoicing account (for example Moloni, InvoiceXpress or Vendus). The invoices are yours and you remain responsible for your tax obligations.
Your clients' details
- For your clients' personal details you are the controller and we process them for you, under our data processing terms, which form part of these terms.
- You are responsible for having a lawful reason to hold those details, for your own privacy notice (you can link it from your booking pages in Settings), and for any consent you need, such as consent to marketing emails or for a health form.
- You can export your client list and reports at any time.
Services you choose to connect
You can connect other services to Kinhour: marketplaces such as Algarve Circle, text messages, WhatsApp, Instagram and Messenger, invoicing software, door locks, the member app stores, and tools such as Zapier. Each is switched on by you, and the provider's own terms apply to it. If you switch on the front desk assistant, it answers your clients from the information and rules you give it; you can read every conversation and turn it off at any time. Like any automated reply, it can make mistakes, so keep your information up to date.
Fair use and availability
- Do not use Kinhour for anything unlawful, to send messages people have not agreed to receive, or to upload material you do not have the rights to.
- We work hard to keep Kinhour running, but we cannot promise it will never be interrupted. We do not offer a formal service level agreement. If there is a significant outage, we will tell you what happened.
Liability
We are responsible for losses that are a foreseeable result of us breaking these terms. As far as the law allows, we are not responsible for indirect losses such as lost profit, and our total responsibility to a business customer in any twelve months is limited to what that customer paid us in those twelve months. Nothing in these terms limits liability that cannot be limited by law, including for intent or gross negligence, or your rights as a consumer.
Changes and ending the agreement
We will tell you by email at least 30 days before any change to these terms that affects you. You can close your workspace at any time; export anything you want to keep first. When a workspace is closed, we delete its data within 90 days, except invoices and billing records, which Portuguese tax law requires us to keep for ten years. We may suspend a workspace that breaks these terms or puts others or the service at risk, and will tell you why. If we ever need to end the service, we will give you reasonable notice.
Law and disputes
These terms are governed by the laws of Portugal. Disputes go to the courts of the district of Faro, except that a consumer keeps the protection of the mandatory laws and courts of the country where they live.
Consumers in Portugal can also use the electronic complaints book at livroreclamacoes.pt and the consumer arbitration centre for the Algarve, CIMAAL, at consumoalgarve.pt.
